Vocational Scenario 1:

You are working as a Legal Assistant in a law firm, Irwin Mitchell Solicitors, which advises new start- up companies on the legal systems and key legislation that they are required to know and apply. You have been asked to write a report on the nature of law for new companies to support the business advice and guidance provided.

Assignment activity and guidance

  1.  Your report should cover the following areas:
  • Discuss three sources of English law and their role in shaping the UK legal system. (1)
  • Explain the process (overall role) by which the UK government enacts legislation and implement statutory and common law in UK courts (2). Briefly outline how company law regulates UK businesses and provide specific examples of this impact.
  •  Using specific legal cases from the past, and explain how company, employment law and contract law govern the employer-employee and contractor relationship? (3)
  • Distinguish between legislation, regulations, and standards in the context of business contracts. Briefly explain the potential impact of each on businesses.  Additionally, provides a coherent and critical evaluation of the legal system and law, with evidence drawn from a range of different relevant examples to support judgments.

Scenario 2

Saunders is an aspiring entrepreneur and would like your advice on how different types of organisations are legally formed, managed, and funded. He is attending the Small Business Expo 2023 conference being held in London in which you as a Paralegal, and have been invited to attend as a guest speaker. However, you will only have to prepare a brochure.

Assignment Activity and Guidance:                 

Write a report and prepare a brochure to:

  • Explore the different options to legally set up a business in the UK such as sole trader, partnership, and limited company recommending the best fit for future goals.(4)  Also, analyse their advantages and disadvantages .
  • Explore how above-mentioned business organisations are managed and how various businesses types can raise finance to fund their operations in the UK. (5)

LO4:  Recommend appropriate legal solutions to resolve areas of dispute.

Scenario 3

Thompson is a German citizen who has been running a Dormitory Hostel in South – West London for EU students near to his home. A new owner Martin of the next-door butcher shop often keeps his bins open in the back garden. That has been causing huge nuisance to Hostel residents.

Thompson called Martin several times but no action. Thompson contacted a local Solicitor, but they advised Thompson to attend in person and pay consultation fees £500.00 + VAT. They discussed about court proceeding which may take 3-6 months, proceeding and Hearing fees etc.

Thompson got a new contract to supply freshly prepared breakfast, lunch and afternoon tea for Investment Bank in London Bridge. Thompson is too busy to miss even a single shift. One mistaken step may damage his businesses as there are other competitors.

Thompson is also scared of court for complications, fees and time. Simultaneously, Thompson needs to resolve his Hostel crisis.

You are required to

  • Provide a written report to identify suggesting three different legal solutions for three legal issues/situations (regarding employment, commercial, and contractual areas, one each), (6)
  • Also, in a table, compare and contrast merits and demerits of alternative methods of dispute resolution.
  • Additionally, critically evaluate the effectiveness of legal solutions, legal advice and support for dispute resolution.
