LW601 Assignment Task

Answer the following question: Consider the validity of the following gifts in the will of Daphne, who died in 2014: 

(a) £100,000 to my trustees for the establishment and maintenance of a walled garden within the precincts of St Luke’s Church, for the quiet reflection of the parishioners. 

(b) £10,000 to my trustees to be distributed to such organisations involved in the protection of the environment and related causes as they shall in their absolute discretion select; and 

(c) £50,000 to my trustees for the promotion of tennis in the public schools of Derbyshire. Consider whether these gifts are charitable.

  • LO1: Explain the key principles and rules of Equity and Trusts by analysing key cases and statutes, identifying principal rules by applying techniques of interpretation to them.
  • LO2: Apply those rules to factual situations of some complexity and produce a reasoned judgment of possible outcomes
  • LO3: Explain doctrinal and conceptual difficulties and recognise alternative approaches and outcomes, and areas of uncertainty.
  • LO4:Apply those rules to complex factual situations and produce a reasoned judgment of possible outcomes.
  • LO5:Write in comprehensible English using legal terminology with accuracy and produce the text of an essay with footnotes, references, and basic formatting using a standard software package.
